Refund Policy - Yog Sports Foundation

At Yog Sports Foundation, we deeply value the trust you place in us by registering for our yoga championships, teacher training programs, workshops, and wellness initiatives. This Refund Policy explains in detail our principles, procedures, and guidelines concerning refunds, cancellations, and rescheduling. We ensure transparency and fairness, balancing organizational commitments with participant convenience.

Introduction

This Refund Policy is hereby instituted by the Yoga Sports Foundation (hereinafter referred to as “YSF”), in recognition of the need to maintain transparency, accountability, and fairness with all stakeholders including but not limited to yoga players, coaches, referees, volunteers, event participants, training program enrollees, institutional partners, and associated members. The Foundation acknowledges that refunds may become necessary in certain circumstances. Such refunds must be administered in a manner consistent with the ethical principles of yoga—Satya (truth), Ahimsa (non-harm), and Aparigraha (non-possessiveness)—while adhering to applicable statutory and contractual obligations.

General Refund Guidelines

The overarching principle governing refunds shall be that YSF is under no obligation to issue refunds except as explicitly provided herein. Refund requests shall be reviewed on a case-by-case basis, with particular consideration accorded to (i) the timing of the request, (ii) the nature of the program, event, or service, and (iii) the demonstrable expenditures already incurred by the Foundation in reliance upon the enrolment, registration, or contractual engagement of the requesting party.

Refunds shall, wherever feasible, be processed through the original mode of payment, unless both parties expressly agree, in writing, to an alternative method of disbursement. The Foundation reserves the right to deduct administrative fees, transaction charges, and proportionate costs reasonably attributable to the service availed prior to the request for refund.

Scope of Applicability

This Refund Policy applies to all transactions undertaken with YSF, including but not limited to:

Timeframes for Refund Eligibility

Refund eligibility is strictly contingent upon timely notification. Unless otherwise specified by a program-specific agreement, the following timeframes shall apply:

Exceptional Circumstances

Notwithstanding the general restrictions delineated hereinabove, refund claims may, under limited and extraordinary situations, be entertained strictly at the absolute discretion of the Yog Sports Foundation (YSF). Such extraordinary situations shall include, but not be confined to:

In each of the aforesaid circumstances, the burden of proof shall lie exclusively upon the claimant. All claims must be supported with original, verifiable, and legally recognized documentation. Submission of forged, incomplete, or otherwise dubious documentation shall result in immediate disqualification of the claim and may entail blacklisting from all future YSF initiatives.

It is further clarified that mere inconvenience, change of personal schedules, financial incapacity, or dissatisfaction with program content shall not constitute exceptional circumstances. YSF’s decision, as rendered by its Board of Directors or an authorized adjudicating committee, shall be final, conclusive, and binding, and shall not be open to challenge in any forum, judicial or quasi-judicial, unless otherwise mandated by prevailing law.

Non-Refundable Fees

Without prejudice to any other provisions contained herein, and notwithstanding any equitable considerations that may otherwise be invoked, the following fees, charges, and contributions shall be deemed irrevocably forfeited upon payment and shall not, under any circumstances, be eligible for refund, reimbursement, set-off, or credit, save and except where expressly mandated by statutory law. The below list, though enumerative, shall not be construed as exhaustive, and YSF reserves the right to designate additional categories of non-refundable payments, provided adequate prior notice is issued.

By remitting payment, the participant, donor, or contracting entity explicitly acknowledges and waives any future claims to the recovery of the above-mentioned fees. YSF shall not entertain, mediate, or arbitrate disputes pertaining to these categories, except where statutory compulsion unequivocally overrides this clause.

Process of Claiming Refund

In order to maintain transparency, accountability, and procedural uniformity, all requests for the initiation of a refund must be duly submitted in a formal written format either (i) via electronic mail addressed exclusively to the officially designated YSF correspondence address, or (ii) through a duly authorized online portal or digital interface established by YSF for such purposes (if and when applicable). Submissions via informal communication channels (including but not limited to personal correspondence, verbal requests, or social media messaging) shall not be recognized as valid claims.

The request must, in the interests of clarity, fairness, and administrative efficiency, contain with precision and without ambiguity the following mandatory particulars:

  1. Full legal name of the claimant, consistent with the identity documents submitted at the time of enrollment or transaction.
  2. Exact nature, title, and description of the program, event, service, or product purchased, including batch number or session details where relevant.
  3. Date of payment, amount paid, transactional reference number, and the mode or channel through which such payment was executed (e.g., bank transfer, credit/debit card, online gateway, etc.).
  4. Comprehensive explanation and rationale for the refund request, articulated in sufficient detail to enable proper adjudication of the claim.
  5. Supporting documentation, if any, including but not limited to medical certificates, receipts, legal notices, banking records, or any other documentary evidence deemed material to the claim.

Upon receipt of the refund application, YSF shall formally acknowledge said submission within seven (7) working days, such acknowledgment being limited to confirmation of receipt only and not to be construed as acceptance or approval of the claim. The substantive review, verification, and adjudication process shall be undertaken by the authorized Refund Committee of YSF, whose decision shall be guided by established internal policies, fairness principles, and applicable statutory obligations, if any.

The claimant shall be duly informed in writing of the determination within thirty (30) working days from the date of acknowledgment. In the event that the claim is adjudicated in the claimant’s favor, the approved refund amount (if any) shall be remitted within fifteen (15) working days thereafter, subject always to banking timelines, transaction processing delays, and compliance with relevant financial formalities. YSF expressly disclaims responsibility for delays attributable to third-party financial institutions or unforeseen external circumstances.

For the avoidance of doubt, any claim that fails to comply with the procedural requirements herein, is incomplete in essential particulars, or is unsupported by verifiable evidence, may be summarily rejected at the discretion of YSF without further liability. The decision of YSF in respect of any refund application shall be final, binding, and not subject to further dispute or appeal, save as may be required under applicable law.

Dispute Resolution

In the eventuality that any disagreement, controversy, or claim arises in connection with, or relating to, refund requests, refund processing, or the interpretation and enforceability of these refund-related provisions, such matters shall, in the first instance, be mandatorily referred to amicable mediation under the auspices of the Yog Sports Foundation (YSF) Internal Grievance Redressal Committee. The Committee shall exercise its mandate to facilitate good-faith negotiations between the claimant and YSF, with the intent of achieving a fair, equitable, and mutually acceptable resolution within a reasonable period of time.

In the event that mediation efforts do not yield a resolution acceptable to both parties, the dispute shall then, without recourse to ordinary litigation, be mandatorily and exclusively referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The seat and venue of such arbitration shall be Noida, Uttar Pradesh, India, and the arbitral proceedings shall be conducted in the English language unless otherwise mutually agreed in writing.

The arbitral tribunal shall consist of a sole arbitrator, or, in the event of non-consensus between the parties, a panel of three arbitrators constituted in accordance with the governing statute. The arbitral award so rendered shall be final, conclusive, and binding on all parties, and shall not be subject to appeal except as permitted under the limited statutory provisions for challenge. The parties hereby expressly waive any objection on the grounds of jurisdiction, venue, or competence of the arbitral tribunal, subject to the applicable provisions of law.

Without prejudice to the foregoing, YSF and the claimant retain the right to seek judicial enforcement or injunctive relief for the arbitral award or any interim measures before the competent courts of India, specifically within the jurisdiction of Noida, Uttar Pradesh. This clause shall survive the termination, expiration, or cessation of any contractual or programmatic relationship between the parties and shall continue to govern the resolution of disputes relating to refund claims.

Amendments

The Yog Sports Foundation (hereinafter referred to as "YSF") expressly reserves, without limitation, qualification, or condition, the inherent, absolute, and unilateral prerogative to amend, revise, modify, supplement, suspend, repeal, replace, or otherwise alter, either in whole or in part, the provisions, stipulations, and operative clauses of this Refund Policy (hereinafter referred to as "Policy") at any time and from time to time, at its sole discretion, with or without prior notice to stakeholders, subject only to the overarching principles of equity, natural justice, and statutory compliance as mandated under prevailing laws of the Republic of India.

It is hereby clarified that any such amendment, modification, or alteration, whether procedural or substantive, shall become effective immediately upon being published, posted, or otherwise communicated via the official website of YSF, or by any other mode of dissemination deemed fit and appropriate by YSF, including but not limited to written circulars, email notifications, or public notices. The date of such publication shall, for all intents and purposes, constitute the effective date of amendment, and all stakeholders shall be deemed to have constructive notice thereof irrespective of actual knowledge or acknowledgment.

For greater certainty, it is explicitly provided that no amendment, however extensive or fundamental, shall operate retrospectively so as to adversely prejudice, diminish, impair, extinguish, or nullify any refund claim that has already been duly submitted, acknowledged, and formally registered with YSF prior to the date of such amendment. All refund applications filed before the effective date of amendment shall continue to be governed by the unamended provisions of this Policy, save and except where the amendment is of a procedural, clarificatory, or beneficial nature, in which case such amendment may, at the sole discretion of YSF, be applied retroactively in order to promote fairness, uniformity, and justice.

It is further stipulated that stakeholders, including but not limited to claimants, participants, affiliates, sponsors, vendors, contractors, and associated institutions, are under a continuing obligation to remain apprised of the current version of this Policy as may be applicable from time to time. Failure to review or ignorance of amendments shall not, under any circumstances, be construed as a defense, justification, or mitigating factor in any dispute, claim, or proceeding arising from or related to refunds.

In the event of any conflict between the provisions of this Policy and any amendment thereto, the provisions of the amendment shall prevail to the extent of inconsistency, without derogation to the residual clauses of the original Policy. Where ambiguity arises from simultaneous or successive amendments, the most recent amendment shall be deemed to reflect the prevailing intent and binding force of YSF.

Amendments may be classified into categories, including but not limited to:

YSF also retains the irrevocable authority to convene a Policy Review Committee, comprised of members of the Governing Body, external legal advisors, auditors, and domain experts, to periodically evaluate the continued relevance, sufficiency, and effectiveness of this Policy in light of evolving legal frameworks, industry standards, and stakeholder feedback. The recommendations of such committee, once ratified by YSF, may directly inform subsequent amendments.

All amendments enacted by YSF shall be considered binding, authoritative, and final, and shall not be subject to challenge except on grounds of manifest arbitrariness, mala fides, or violation of statutory provisions. In case of disputes regarding interpretation of any amendment, the interpretation accorded by YSF shall be deemed conclusive and shall prevail unless set aside by a competent judicial or arbitral authority.

Moreover, YSF reserves the liberty to introduce transitional arrangements, whereby stakeholders may be granted a grace period to adapt to significant amendments. Such transitional arrangements may include staggered implementation timelines, partial grandfathering of pre-amendment entitlements, or phased integration of procedural reforms. The extent and duration of such transitional measures shall be determined exclusively by YSF, taking into account the gravity of amendment, stakeholder impact, and practical considerations.

Stakeholders are strongly advised, and in fact obligated, to maintain continuous vigilance with respect to updates and communications issued by YSF. The responsibility for tracking amendments lies exclusively with the stakeholders, and any reliance upon outdated or superseded versions of this Policy shall be undertaken at their own risk, peril, and detriment.

It is finally reiterated, in the most emphatic terms, that YSF, as an institution committed to transparency, accountability, and equitable administration, shall exercise its amendment powers judiciously, proportionately, and in good faith. Nonetheless, the very existence of such powers shall not be interpreted as a contractual waiver, dilution, or abdication of YSF’s rights, but rather as a necessary safeguard to ensure adaptability, legal compliance, and resilience in a dynamic and evolving operational environment.

In conclusion, the clause on Amendments must be understood as a living, evolving, and dynamic component of this Policy, designed to reflect the fluid realities of law, governance, and institutional practice. The stakeholders’ duty of compliance is continuous, and their rights are preserved in balance with the foundational prerogatives of YSF. By continuing to engage with YSF’s programs, products, or services, stakeholders signify their explicit acknowledgment of and consent to the amendment framework as outlined herein.

Legal Disclaimer

Nothing in this Refund Policy shall be construed as creating a binding obligation on YSF beyond what is explicitly set forth herein. This policy is intended to provide guidance and is subject to overriding provisions of applicable law. In the event of any inconsistency between this Policy and applicable law, the latter shall prevail.

Event Registrations

All individuals, institutions, or entities (“Participants”) seeking to register for any championship, yoga competition, workshop, training seminar, or other public event organized under the auspices of the Yoga Sports Foundation (YSF) acknowledge, agree, and expressly consent to the following terms and conditions, which are binding in nature and carry the force of a contractual undertaking.

By completing the registration process, Participants affirm that they have read, understood, and voluntarily accepted all provisions herein, including the refund framework, cancellation restrictions, and related procedural requirements. It is expressly clarified that registration fees once remitted shall be deemed as consideration not merely for participation in the event but also for YSF’s commitment to engage in significant and irreversible logistical, administrative, and promotional expenditures.

Refund Structure:

For avoidance of doubt, YSF shall not, under any circumstances, be held liable for reimbursement of ancillary or collateral costs incurred by Participants, including but not limited to travel expenses, accommodation bookings, visa fees, insurance premiums, or any other consequential or incidental costs, whether foreseeable or unforeseeable, arising from the cancellation of participation.

Furthermore, it is hereby stipulated that any request for refund must be submitted in writing through the prescribed digital or physical channels as notified on the official YSF website. Such requests shall be processed strictly in accordance with the timelines and procedures determined by YSF at its sole discretion, and no oral commitments, representations, or assurances provided by any employee, volunteer, or affiliate of YSF shall be deemed valid unless expressly ratified in writing by an authorized officer of the Foundation.

YSF also reserves the inalienable right to cancel, postpone, or reschedule any event, championship, or related program due to unforeseen circumstances including but not limited to acts of God, force majeure events, public health emergencies, governmental orders, or other circumstances beyond its reasonable control. In such instances, YSF shall, at its sole and absolute discretion, either (a) transfer the Participant’s registration to a future event of similar nature and scale, or (b) issue a partial refund after appropriate deductions to cover administrative overheads. Participants acknowledge and agree that such remedies shall constitute the sole and exclusive recourse available to them, and they shall not be entitled to pursue any additional claim for damages, compensation, or restitution under any legal theory whatsoever.

By proceeding with registration, Participants expressly waive any claim against YSF for punitive, indirect, special, or consequential damages arising from participation, cancellation, or non-participation in the event, save and except to the limited extent expressly provided herein. These terms are intended to ensure the fair and equitable treatment of all parties while safeguarding YSF’s operational and financial stability.

Yoga Teacher Training Programs

The Yoga Sports Foundation (hereinafter referred to as "YSF") expressly recognizes the substantial commitments of time, effort, and resources required in the organization, coordination, and delivery of its Yoga Teacher Training Programs, which include but are not limited to the 100-hour foundational program, the 200-hour professional certification program, and advanced, specialized modules designed for senior practitioners. In recognition of the highly structured nature of these programs—encompassing classroom instruction, practicum, mentoring sessions, digital study resources, and trainer allocation—YSF has adopted the following comprehensive refund, cancellation, and deferment policy, which shall apply in full force and effect to all individuals (hereinafter referred to as "Participants") who seek admission or have been admitted into such programs.

(i) Cancellations made forty-five (45) days or more prior to the official commencement date of the program shall be entitled to a refund of seventy-five percent (75%) of the tuition fee paid, subject to deduction of any applicable administrative charges, foreign transaction fees, and statutory levies. Such refunds shall be processed within ninety (90) business days, provided the Participant submits a formal written request, supported with all necessary documentation, to the designated YSF administrative office.

(ii) Cancellations made between thirty (30) and forty-four (44) days prior to the commencement date shall be entitled to a refund of fifty percent (50%) of the program fee, again subject to the deduction of applicable administrative charges, statutory dues, and costs already incurred by YSF in relation to trainer scheduling, venue booking, printed material procurement, and other preliminary expenditures. Such refund shall be processed in accordance with the timelines specified above, and YSF shall not be liable for any consequential losses or damages claimed by the Participant.

(iii) Cancellations made less than thirty (30) days prior to the commencement date shall not be eligible for any refund whatsoever. However, in recognition of unforeseen exigencies, YSF at its sole and unfettered discretion may permit the Participant to defer his or her enrollment and transfer the admission to one (1) subsequent batch of equivalent nature, subject to availability of seats, parity of course structure, and compliance with any revised tuition fee schedules that may come into effect at the time of transfer. Such transfer rights shall be exercised strictly once and shall not be extended to subsequent batches beyond the immediately following intake, except in cases of documented medical emergencies, force majeure, or other exceptional circumstances which YSF deems valid.

(iv) Notwithstanding the foregoing provisions, no Participant shall be entitled to any refund of amounts already utilized toward non-refundable deposits, visa issuance (in the case of international students), travel bookings, insurance, accommodation arrangements, or any third-party service provider charges, which shall remain the sole responsibility of the Participant. Participants are therefore strongly encouraged to obtain appropriate insurance coverage to mitigate the risk of financial loss arising from unforeseen withdrawal or deferment.

(v) Participants who voluntarily discontinue the program after it has commenced, whether due to personal reasons, inability to cope with the rigor of the curriculum, lack of attendance, disciplinary action, or medical incapacity, shall not be entitled to any refund of fees paid. YSF shall, in such cases, consider on compassionate grounds the possibility of allowing partial credit for attendance and coursework completed, which may be applied toward a future enrollment, provided that such application is made within one (1) calendar year from the date of original discontinuation. The grant of such credit shall be entirely discretionary and shall not create any binding obligation upon YSF.

(vi) All Participants expressly acknowledge that refunds, if and when sanctioned, shall be made solely to the original mode of payment or to the account from which the payment originated. YSF shall not entertain requests to redirect refunds to third-party accounts, except under legal compulsion or upon presentation of a notarized indemnity bond duly executed by the Participant. Any and all bank charges, wire transfer fees, conversion charges, and transaction fees applicable to refund remittances shall be borne exclusively by the Participant.

(vii) YSF further reserves the absolute right, at its discretion, to alter, amend, or modify the structure, faculty assignments, schedules, or delivery modes of the Teacher Training Programs (including, but not limited to, shifting sessions to online platforms, hybrid models, or alternate venues) in response to force majeure events, governmental restrictions, natural calamities, pandemics, public health emergencies, or any other circumstances beyond the reasonable control of YSF. In such cases, Participants shall not be entitled to claim any refund, but YSF shall endeavor to provide reasonable accommodations, equivalent learning outcomes, and access to course materials to minimize disruption.

(viii) It is expressly understood and agreed that enrollment in YSF’s Teacher Training Programs constitutes an acknowledgment and acceptance of the binding nature of this Refund and Cancellation Policy. All disputes, claims, or controversies arising in relation to refunds, deferments, or cancellations shall be subject to the exclusive jurisdiction of the courts situated within the territorial limits of India, unless otherwise mandated by statutory provisions applicable to international Participants. Participants shall also be deemed to have waived any class-action rights and shall submit disputes, where applicable, to individual arbitration in accordance with the rules prescribed by the Arbitration and Conciliation Act, 1996, or any statutory re-enactment thereof.

(ix) By remitting payment of tuition fees, submitting enrollment forms, or otherwise participating in YSF’s Teacher Training Programs, Participants affirm that they have read, understood, and irrevocably consented to all terms and conditions set forth herein. This policy shall form an integral and inseparable component of the Participant’s contract of enrollment with YSF and shall survive the termination, expiration, or completion of the training program.

Workshops & Retreats

In respect of specialized workshops, retreats, residential immersions, and allied experiential learning programs conducted under the auspices of YSF, the refund framework is designed with due cognizance of the substantial logistical, contractual, and fiduciary obligations that are incurred well in advance of the scheduled commencement date. Such obligations may include, but are not limited to, advance payments towards venue reservations, accommodation facilities, transportation arrangements, procurement of training materials, engagement of faculty and resource persons, marketing expenditures, statutory compliances, and other binding contractual commitments with third parties. Accordingly, participants and registrants expressly acknowledge, by virtue of enrollment, that the financial and administrative implications of last-minute cancellations materially impact the viability of such programs and that refunds are therefore restricted in scope. The following structured regime shall apply without exception:

YSF reserves the unilateral and discretionary authority to adjudicate any request for deferment, credit note issuance, or substitution of participant(s). Such discretion shall be exercised in a manner consistent with the principles of fairness but shall not be construed as creating a legally enforceable right for the registrant. Furthermore, participants acknowledge that international retreats may entail additional restrictions arising from cross-border regulatory frameworks, immigration requirements, and foreign venue contracts. In such cases, the refund percentages enumerated herein shall be deemed subordinate to, and overridden by, the binding provisions of any foreign contractual obligations or government-mandated restrictions, and YSF shall not bear liability for refunds denied due to such external contingencies. By registering, participants irrevocably accept that this clause constitutes a material term of the enrollment contract and expressly waive any claim against YSF, its officers, directors, or affiliates, for consequential damages, lost opportunities, or incidental costs (including but not limited to airfare, visa fees, or accommodation booked independently by the participant) in the event of cancellation or modification of the program.

Special Considerations

Yog Sports Foundation acknowledges that participants may occasionally encounter unforeseen and unavoidable circumstances, including but not limited to medical emergencies, accidents, force majeure events, or natural calamities, which may materially affect their ability to attend or participate in scheduled programs. In such exceptional cases, registrants may formally submit a written request for partial refund, credit, or rescheduling of participation, accompanied by verifiable supporting documentation (such as medical certificates, police reports, or government-issued advisories).

All such requests shall be subject to the sole discretion of the Foundation’s administrative committee, whose decision shall be final and binding. While the Foundation aspires to extend compassion, reasonableness, and fairness in its decision-making, it shall not be under any legal or contractual obligation to provide refunds or alternative arrangements beyond what is expressly stipulated herein. The Foundation further reserves the right to evaluate each request on a case-by-case basis, taking into account logistical commitments, contractual obligations with third parties, and the financial viability of the event or program in question.

By registering for any event, program, or training conducted under the auspices of Yog Sports Foundation, the participant expressly agrees that any such concessions, if granted, are to be regarded as a gesture of goodwill and shall not constitute an admission of liability, waiver of rights, or precedent for future claims.

Non-Refundable Situations

The Yog Sports Foundation (hereinafter referred to as "YSF") upholds a transparent and equitable approach to financial transactions pertaining to registrations, trainings, workshops, and digital resources. However, in order to maintain the integrity of our administrative processes, safeguard the investments committed toward operational resources, and ensure consistency in service delivery, it is imperative to define and enforce specific non-refundable situations. These conditions are binding upon all registrants, participants, and stakeholders once acceptance of registration and payment has been duly confirmed. By proceeding with payment, every participant expressly acknowledges and agrees to these non-refundable clauses, which are construed to be legally enforceable in favour of YSF.

1. Competitions: Registration fees for competitions, tournaments, or championship events are strictly non-refundable once a participant has competed or has been officially registered on the competition roster. This is because YSF undertakes advance expenditures including but not limited to venue booking, judges’ and referees’ fees, promotional expenses, and third-party vendor payments. Even in circumstances where a participant withdraws voluntarily or becomes unable to perform after registration, the financial and organizational commitments already incurred by YSF remain irrevocable. Therefore, no claims for reimbursement shall be entertained.

2. Completed Training Sessions: Fees for yoga teacher training programs (whether 100-hour, 200-hour, or advanced modules) become entirely non-refundable once a participant has availed of the scheduled sessions. Attendance, whether partial or complete, shall constitute consumption of services, thereby nullifying refund eligibility. This applies irrespective of the participant’s perceived personal benefit, satisfaction, or lack thereof. The legal doctrine of quantum meruit further supports YSF’s position that once services are rendered, payment is fully earned and cannot be reversed.

3. Digital Resources: Purchases made for eBooks, recorded lectures, online video modules, or downloadable content are unequivocally non-refundable under all circumstances. As these resources fall under the category of intellectual property and are instantly accessible post-purchase, YSF retains the exclusive right to enforce a strict "no-refund" policy in alignment with prevailing global e-commerce standards. Unauthorized distribution or reproduction of such materials will attract legal action under copyright laws.

4. Force Majeure Situations: In the event of natural disasters, government restrictions, pandemics, or unforeseen events beyond the reasonable control of YSF, all registrations and payments already received shall be deemed non-refundable. However, as an act of goodwill, YSF may, at its sole discretion, provide the option to reschedule participation or grant credit vouchers usable for future programs. Such discretionary relief shall not, however, be construed as a legal or binding obligation.
